§ 13-321. Enumerated.

The materials regulated by this article shall consist of the following:

(1)

Any material which is listed on the list of Environmental Protection Agency (EPA) pollutants, 40 CFR 117, as a hazardous substance and/or hazardous or acutely hazardous waste, 40 CFR 261, as amended, whether such material is stored or handled in waste or nonwaste form;

(2)

Any material which is listed in the department of transportation regulations within 49 CFR 100—199;

(3)

Any material which is classified by the National Fire Protection Association (NFPA) as either a flammable liquid, a class II combustible liquid or a class IIIA combustible liquid;

(4)

Any material which is listed by the State Secretary of Labor in the State toxic substance list or similar list deemed appropriate by the Fire Marshal, which is not otherwise regulated pursuant to this section; or

(5)

In addition to the materials listed in this section, any material which has been determined to be hazardous based upon any appraisal or assessment by or on behalf of the party storing this material.
