The Fire Marshal shall have the right to enter upon any private property upon which
is located a business with a City or county business tax receipt and enter any buildings
located thereon for the purpose of inspecting for the existence of public nuisances
and to carry out any of the obligations of the Fire Marshal's office under this division.
The Fire Marshal may enter any such property or business at any time during normal
business hours. The Fire Marshal may enter any business establishment which has a
business tax receipt or any other governmental license for any operation which can
use or store hazardous materials at any time either during normal business hours,
when the business is open to the public, or during other hours upon reasonable advance
notice. The Fire Marshal may enter any property or building at any time without advance
notice if there is substantial reason to believe hazardous materials are stored or
used therein and that the materials storage or use poses an imminent danger to public
safety. The Fire Marshal may resort to the process of the court to enforce such right
of access. It shall be unlawful for any person to refuse entry to the Fire Marshal.
