§ 16.40.110.1. Generally.

  • A.

    An existing porch, whether it is in a required yard or not, may be enclosed with transparent insect screening material so long as the original opening configuration and original design features including such details as railings, columns and other building details are maintained. This screening is not new construction and does not require compliance with the requirements of the current zoning district regulations.

    B.

    Enclosing any opening configuration of an existing porch with walls, windows, doors or any other treatment other than transparent insect screening materials shall meet the following requirements:

    1.

    Front and street side yard porches that are required as part of the current design standards and which are located within a required yard for open front porches shall not be enclosed.

    2.

    Front and street side yard porches that are required as part of the current design standards and are not located within a required yard may be enclosed. The enclosure shall comply with all of the design standards of the applicable zoning district.

    3.

    Front and street side yard porches that are not required as part of the current design standards may be enclosed whether they are in a required yard or not.

    4.

    Interior side and rear yard porches may be enclosed if they comply with all yard requirements and design standards of the applicable zoning district.

    C.

    Where an existing porch was lawfully enclosed, any walls, windows, doors or any other treatment may be replaced without obtaining a variance.

    D.

    Where a porch has been located or constructed after obtaining a variance to a required yard or in compliance with the setbacks consistent with established neighborhood patterns regulations in an NT or NS zoning district, such porch is no longer in a required yard and may be enclosed if allowed by the other provisions of this section.
