§ 16.50.210.1. Use restrictions.

    In any zoning district in which there is a permitted development of residential dwellings, the developer may operate a model home use, subject to the following restrictions:

    1.

    For the purposes of this section, the term "model home use" includes model homes, sales office, and sales centers with a combination of model rooms and sales offices.

    2.

    The model home use shall meet all district requirements for lot and yard dimensions.

    3.

    The sales office, if not in the home, shall not exceed 750 square feet and is an accessory use on the same lot. It shall only be used by the developer and shall only be used in connection with the development in which located.

    4.

    Model homes uses and signs shall not be illuminated after 9:30 p.m. and shall not be used for any business activity after 10:00 p.m.

    5.

    At least five off-street parking spaces shall be provided on the same lot as the model home use or on a contiguous lot, and shall be maintained so long as the model home use is used for the sale of homes in the development.

    6.

    A strip of land at least 20 feet wide shall be landscaped and maintained between any model home use or parking area and any adjacent land, not in the development, which is used for residential uses.

    7.

    Model home uses shall not be used as a means to sell similar homes for a period longer than two years; provided, however, the DRC may, after public hearing, grant an extension for a period not to exceed an additional two years from the date the certificate of occupancy for the model home use was issued.

    8.

    These regulations shall not apply a home displayed as a model home for less than three months, where no accessory office is erected.

    B.

    Model home uses may be erected or displayed in districts where single-family dwellings are prohibited, provided that such uses shall not be used for residential purposes, but only for display as a means to sell similar homes in districts in which they are permitted. All requirements of the district in which the model home use is erected shall be met.
