§ 17-158. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Canvasser or solicitor means any person, whether a resident of the City or not, traveling either by foot, automobile, truck or any other type of conveyance from house to house or from street to street, taking or attempting to take orders for the sale of goods, wares or merchandise, subscriptions, personal property of any nature whatsoever for future delivery, or for services to be furnished or performed in the future whether or not such individual has, carries or exposes for sale, a sample of the merchandise or whether collecting advance payments on such sales or not. The term "canvasser" or "solicitor" includes any person who hires, leases, uses or occupies any building or structure, or any other place within the City for the sole purpose of exhibiting samples and taking orders for future delivery.

    Peddler means any person, whether a resident of the City or not, traveling by foot, automobile, truck or any other type of conveyance from house to house or from street to street, carrying, conveying or transporting goods, wares and merchandise, offering and exposing them for sale, or making sales or delivering articles to purchasers or who, by traveling from house to house, or street to street, shall sell or offer the same for sale from an automobile, truck, or any other type of conveyance; one who solicits orders and, as a separate transaction makes deliveries to purchasers as a part of the scheme or design to evade the provisions of this article, shall be deemed a peddler, subject to the provisions of this article. The term "peddler" includes the terms "hawker" and "huckster."
