§ 17-329. Records and reports; consent by licensee.
(a)
Each licensee shall keep such records and make such reports as are required under this article. Whenever the information required by or provided in the application has changed, the licensee shall promptly provide the POD with the changed information.
(b)
Consent. By holding a license under this article, the licensee shall be deemed to have consented to the provisions of this article and to the exercise by the POD and the Chief of Police administering this article and their respective responsibilities under this article.
(c)
The licensee of an adult use establishment is responsible for keeping a record of all employees and independent contractors who are currently employed or hired by the adult use establishment, and of all former employees and independent contractors who were employed or hired by the adult use establishment during the preceding one-year period. The record shall contain the current or former employee's full legal name, including any aliases, and date of birth and shall contain a copy of the independent contractor's business tax receipt. A recent photograph of all current employees and independent contractors shall also be a part of the record.
(d)
The original records required by subsection (a) of this section, or true and exact photocopies thereof, shall be kept at the adult use establishment at all times. Any operator of an adult use establishment shall be responsible for knowing the location of the original records or the true and exact photocopies thereof.
(e)
Any operator of an adult use establishment shall, upon request by a Law Enforcement Officer, Health Department Official, or the POD while the establishment is open for business, immediately make available for inspection the original records, or the true and exact photocopies thereof, required by this section.
