§ 21-1. Definitions.

  • (a)

    The following words, terms and phrases, when used in this chapter, shall, when capitalized, have the meanings ascribed to them in this subsection:

    Charter Park means property owned by the City and designated Park Property on the Park and waterfront property map of the Charter or specifically designated as a Charter Park Property pursuant to article III of this chapter.

    Non-Charter Park means City-owned properties not permanently designated as Park Property as provided in the Charter, but which are temporarily used for park uses.

    Park or Park Property means all Charter Park Property and Non-Charter Park Property; and all water completely surrounded by land owned by the City or by rights-of-way or by a combination thereof, including the public parking lots serving any of the referenced property in this definition.

    (b)

    The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Days means business days and shall not include Saturdays, Sundays or holidays observed by the City, unless this section specifically refers to calendar days.

    Laws means all federal, State and local laws, rules, regulations and ordinances, and City and department policies and procedures.

    Negligence means the failure to use reasonable care. Reasonable care is that degree of care which a reasonably careful person would use under like circumstances. Negligence may consist either in doing something that a reasonably careful person would not do under like circumstances or in failing to do something that a reasonably careful person would do under like circumstances.

    Park permit means any written license issued by the POD authorizing a special event or activity in a park.

    Public issue or political speech or conduct means that noncommercial expression of ideas of public concern related to government, religion, economics, society, culture and matters of a similar nature as determined by the courts of the controlling jurisdiction to be entitled to the greatest protection of the First Amendment of the United States Constitution.
