§ 21-48. Wildlife; domestic animals generally.

  • (a)

    (1)

    It is unlawful to pursue, catch, molest or kill any animals in any Park, or disturb the nest, den or burrow thereof except to fish as allowed pursuant to this article without a park permit.

    (2)

    It is unlawful to release any exotic or non-native animal in any Park.

    (b)

    No person shall allow or permit any domesticated animal to run at large or create a nuisance, or to be in any Park where such animals are prohibited by the POD.

    (c)

    No owner of an animal, or person in charge of an animal, shall allow or permit the animal to be in the following Park (not including being on a sidewalk abutting a public street): Millennium Youth Playground, generally located at 542 7th Street North.

    (d)

    For the purpose of this section, the term "animal" shall be interpreted broadly to include all manner of living organisms except plants and humans.

    (e)

    Nothing in this section shall prevent dogs from running at large in Parks, or portions thereof, which are designated as "dog parks" by the City Council. Prior to such designation becoming effective, the City Council shall hold a public hearing. Dog parks shall be fenced and shall have signs posted at each entrance identifying the Park, or portion thereof, as a dog park in which dogs may run at large. Dogs shall be leashed when entering or exiting the dog park. All dogs shall wear a collar and have a current license displayed thereon. Dog owners shall be responsible for all damages to persons or property caused by their dogs. Each dog's owner or person responsible for a dog in a dog park shall remain in the dog park at all times the dog is unleashed. The POD may establish other regulations for any dog park; the failure to follow any posted regulation shall be a violation of this subsection.
