§ 21-55. Radio-controlled model aircraft.
The following restrictions regulate the flying of radio-controlled model aircraft within the City:
(1)
Roads, streets and alleys. Radio-controlled model aircraft shall not be flown over any improved roads, streets or alleys within the City.
(2)
Private property. Radio-controlled model aircraft shall not be flown over private property without the written permission of the owner of that property.
(3)
Identification. Radio-controlled model aircraft flown within the City limits shall have the name and address of the owner displayed on the aircraft.
(4)
Operating under the influence. No person shall operate a radio-controlled model aircraft when:
a.
The person is under the influence of alcoholic beverages, any chemical substance set forth in F.S. § 877.111, or any substance controlled under F.S. ch. 893 when affected to the extent that his normal faculties are impaired; or
b.
The person has a blood or breath alcohol level of 0.10 percent or higher.
(5)
FCC approved equipment. Radio-controlled model aircraft and all equipment associated therewith shall meet the requirements of the Federal Communication Commission.
(6)
General restrictions; City property. General restrictions with respect to flying radio-controlled model aircraft over City-owned property are as follows:
a.
The flying of radio-controlled model aircraft over City-owned property is prohibited except between 9:00 a.m. and sunset.
b.
No radio-controlled model aircraft flown over City-owned property shall have an engine which exceeds a noise level of 96 decibels at three meters from the engine. Those radio-controlled model aircraft having a two-cycle engine shall have a muffler attached if they are flown over City-owned property
c.
Any radio-controlled model aircraft flown over City-owned property shall weigh no more than 11 pounds.
d.
Radio-controlled model aircraft shall not be flown at any time over any City-owned property that is posted by the POD with a sign prohibiting such flying of radio-controlled model aircraft.
e.
Radio-controlled model aircraft shall not be flown over a recreational facility located on a City Park when the facility is being used for the purpose that the facility was intended. By way of illustration and not limitation, golf courses are intended for the playing of golf, soccer fields are intended for the playing of soccer and baseball fields are intended for the playing of baseball. Notwithstanding the foregoing, if a park permit has been issued for a designated area that includes a recreational facility, and that park permit provides for the flying of radio-controlled model aircraft then the flying of radio-controlled model aircraft shall be allowed in accordance with the permit without regard to any use being made of that recreation facility.
f.
Radio-controlled model aircraft shall not be flown over any City-owned parking lot.
