§ 25-73. Application.

  • (a)

    Any person seeking the issuance of an outdoor public assembly permit for the use of a street shall file the application with the Chief of Police.

    (b)

    The application shall be filed at least 30 days prior to the time on which the outdoor public assembly is to be held. An application for an outdoor public assembly permit for a parade shall not be filed more than 180 days prior to the event.

    (c)

    Where an applicant intends to engage in public issue or speech or conduct and the outdoor public assembly has been planned or scheduled by the applicant for less than 30 days prior to the time on which the outdoor public assembly is to be held, the application shall be filed at least five working days prior to the event. If, however, an application is filed in a shorter time frame due to the exigency of the nature of the issue, the City shall process such an application.

    (d)

    The application shall be signed by the applicant under oath, and shall indicate whether the applicant intends to engage in public issue speech.

    (e)

    Applications shall be on forms provided by the Chief of Police and shall set forth the following information and such other information as may be required in order to allow the Chief of Police to evaluate the application for compliance with this article:

    (1)

    The name, place of residence, mailing address and telephone number of the person seeking to conduct the outdoor public assembly.

    (2)

    If the outdoor public assembly is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization and of the authorized and responsible heads of such organization.

    (3)

    The date when the outdoor public assembly is to be conducted.

    (4)

    The type of outdoor public assembly, including a description of the activities which will occur during the event.

    (5)

    The hours when such outdoor public assembly will start and terminate.

    (6)

    A description of any and all recording equipment, sound amplification equipment, banners, signs or other attention-getting devices, including dimensions of and description of materials of any such banners, signs or devices which will be utilized in connection with the outdoor public assembly.

    (7)

    The approximate number of participants, including spectators, which can be reasonably anticipated.

    (8)

    If the outdoor public assembly is designed to be held by, on behalf of or for any person other than the applicant, the applicant for such permit shall file with the Chief of Police a communication in writing from the person proposing to hold the outdoor public assembly, authorizing the applicant to apply for the permit on his behalf.

    (9)

    The exact location of the outdoor public assembly and, if the outdoor public assembly is a parade, the location by streets of any marshaling area or areas for such parade.

    (10)

    A designation of any public facilities or equipment proposed to be utilized.

    (11)

    If the application is for a parade, the application shall also contain the following information:

    a.

    The time at which units of the parade will begin to arrive at the marshaling area, and the times at which all such units will be disbursed therefrom.

    b.

    The starting time of the parade and the approximate length of time that the parade will last.

    c.

    The route to be traveled, including the starting and ending points.

    d.

    The approximate number of persons who, and animals and vehicles which, will constitute such parade and the type of animals and description of the vehicles.

    e.

    A statement as to whether the parade will occupy all or only a portion of the width of the streets or sidewalks to be used.

    (12)

    Whether alcoholic beverages will be sold or consumed at the outdoor public assembly.

    (13)

    A statement that the purpose of the outdoor public assembly and the expected conduct of the participants will conform to all requirements of law, and all ordinances of the City.

    (14)

    A statement whether the outdoor public assembly is for the purpose of public issue or political speech or conduct and if so, the specific purpose of the outdoor public assembly and a general description of the proposed public issue or political speech or conduct.

    (15)

    If the outdoor public assembly is for the purpose of public issue or political speech or conduct, the amount of funds available to pay the cost of City services and whether a claim of indigence is made on behalf of the applicant or the person on whose behalf the application is made and whether the applicant requests a waiver of fees, costs and insurance requirements.

    (16)

    The identity of the individual or entity which will be responsible for payment of City services.
