§ 26-167. Parking penalties.
(a)
A penalty in the amount indicated in this section shall be imposed for the listed parking violations:
(1)
Category I: Overtime parking.

(b)
The fine for disabled permit only for violation of F.S. § 316.1955 shall be reduced under the following circumstances:
(1)
The ticketed vehicle failed to properly display the disabled parking permit (hanger, license plate, sticker, or other approved authorization); and
(2)
The individual operating the vehicle possessed, or was transporting a person who possessed, a valid disabled parking permit at the time the ticket was issued.
Under these circumstances the penalty for the first offense within a 24-month period shall be reduced to $0.00, the penalty for the second offense within a 24-month period shall be reduced to $35.00, the penalty for the third offense within a 24-month period shall be reduced to $52.50, the penalty for the fourth offense within a 24-month period shall be reduced to $70.00, the penalty for a fifth offense within the 24-month period shall be reduced to $87.50, and the penalty for a sixth and subsequent offenses within a 24-month period shall be reduced to $200.00 for each offense. The POD or the City Attorney shall reduce the fine as provided herein upon receipt of evidence clearly showing compliance with the requirements of this subsection. If the failure to properly display the disabled parking permit was due to circumstances beyond the vehicle operator's control, as determined by the City Attorney, such ticket will not be counted towards the number of violations within the 24-month period.
(c)
Surcharge.
(1)
A surcharge shall be added to the parking penalties provided for in subsection (a) for the purpose of funding the City's school crossing guard program.
(2)
The surcharge shall be placed in a City Trust Fund called the "school crossing guard trust fund." Funds collected from this surcharge shall only be used for the purposes allowed by F.S. § 318.21 and shall be distributed to fund the school crossing guard program of the City.
(3)
The amount of the surcharge imposed on each parking violation shall be as follows:
Category I: Overtime (subsection (a)(1) of this section) ..... $7.50
Category II: No parking (subsection (a)(2) of this section) ..... 5.00
Category III: Improper (subsection (a)(3) of this section) ..... 9.00
Category IV: Miscellaneous (subsection (a)(4) of this section) ..... 5.00
(d)
Failure to fully pay. Failure to fully pay any parking ticket and surcharge or to request a court hearing in writing with the parking enforcement division within 15 days of the date of the ticket will result in a $15.00 late fee in addition to the original fine and surcharge amount.
(e)
Waive of right to contest ticket. If there has been no request for a court hearing within 30 days of the date of the ticket, the right to contest the ticket in court will be deemed waived. The only remaining recourse to resolve the ticket after 30 days of the date of the ticket is to pay the fine and late fee.
(f)
Collection of over due tickets. If a parking ticket has not been paid within 90 days of the date of the parking ticket, the City may refer the parking ticket to a collection agency and assess an additional administrative fee of $25.00 per ticket. This fee is due in addition to the original fine amount, the surcharge and the late fee.
(g)
Actions as result of failure to pay. Failure to timely pay the fine or timely request a court hearing may also result in one or more of the following actions: notice of delinquency; summons to appear in court; warrant being issued for vehicle owner's arrest; the inability to renew vehicle registration; or any other lawful action available to the City.
(h)
Maximum penalty. In the event that any court of competent jurisdiction interprets present State law or present State law is amended such that the penalties contained within this section 26-166 exceed the amount permitted by such interpretation or amendment, then the penalty shall be considered to be the maximum allowed pursuant to such interpretation or amendment.
