§ 27-283. Wastewater service charge.
(a)
Established, amount. There is hereby established and imposed upon the owners and/or occupants of all premises which are connected to the sewer system a charge, to be designated "wastewater service charge," which charge shall be based upon the amount of water used on the premises except for that amount of water used for irrigation only accounts as established pursuant to section 27-144, as shown by the following schedule:

In addition to the base charge, there shall be a charge of $6.91 for each 1,000 gallons of potable water registered on the water meter.

Rates charged to customers outside the City in accordance with subsections (1) and (2) of this section shall have added to the rate a surcharge of twenty-five percent (25%) of the total wastewater charge.
(4)
The base charge and any volume charge will apply on all active services; the base charge will apply to all service in standby status; only when a service has been removed will the base charge not be in effect.
(b)
Premises not served by City water. Premises which have a source of water other than the water system and which are discharging wastewater into the sewer system shall pay a charge according to the schedule provided in subsection (a) of this section based upon the estimated amount of water used on the premises.
In the event of a disagreement as to the amount of such water being used proper water metering devices shall be installed to determine that amount at the customer's expense.
(c)
Due date; delinquency. The wastewater service charges shall be billed with the charge for water used and shall be payable and become delinquent at the same time as the charge for water is payable and becomes delinquent. It shall be unlawful for any person occupying premises connected with the sewer system to make use of the facilities of the system after the wastewater service charge becomes delinquent. Upon the charge becoming delinquent, service shall be discontinued.
(d)
Strong waste surcharges. A strong waste surcharge shall apply to all significant industrial users as defined in division 3 of this article.
(1)
Definition. A strong waste is wastewater discharged to the City wastewater system containing a BOD above 300 milligrams per liter (mg/l) or a COD above 600 milligrams per liter (mg/l).
(2)
Monthly surcharge for strong waste. An additional monthly service charge shall be imposed where the waste from any significant industrial user contains an abnormally high BOD or COD concentration constituting a strong waste as defined in subsection (d)(1) of this section.
(3)
Computation. This additional surcharge shall be computed by converting the concentration in mg/l of BOD above 300 or the concentration in mg/l of COD above 600 to total pounds based upon monthly wastewater flow. In cases where the wastewater flow is not metered, this surcharge will be based upon the volume of potable water registered on the potable water meter. The monthly charge for pounds of BOD or COD discharged above these established minimums will be calculated based upon the following rates:

BOD $0.09 COD 0.04 No customer shall be made to pay a surcharge for both BOD and COD for any month. The monthly surcharge will be based upon either BOD or COD, whichever results in the greatest cost-recovery for the City.
(4)
Water quality determination. The concentration of BOD or COD used in the computation of a strong waste surcharge shall be based upon water quality data as required for significant industrial users. Monthly calculation of any strong waste surcharge shall be based upon the average of the two most current water quality readings available for the particular discharge unless more than two readings are available for the month.
