§ 2-492. Solicitation of funds/sale of commercial time.

  • (a)

    The solicitation of funds for the support of cable and broadcast activities shall be the responsibility of the POD, who will provide for proper program endorsement. No solicitation of funds shall occur unless and until subsection (d) of this section has been activated as provided therein.

    (b)

    Promotional announcements for City events, City sponsored or co-sponsored events and events for which the City will receive direct revenue through a contractual relationship are acceptable for cablecast and broadcast at the discretion of the POD.

    (c)

    Promotional announcements for privately-sponsored events, charities, or outside organizations for which the City has no official sponsorship shall not be allowed unless this subsection is activated by a resolution receiving an affirmative vote from at least five members of the City Council. At the time of passage of this resolution, City Council shall establish standards for the approval/disapproval of such announcements. Any questions regarding the appropriateness of any promotional message shall be resolved by the POD.

    (d)

    Sale of commercial time or sponsorship for airing on the broadcast facility is allowed at such time as the City Council activates this subsection by a resolution receiving an affirmative vote from at least five members of the City Council. At the time of passage of this resolution, the City Council shall establish standards for approval/disapproval of advertising. All contracts for commercial time must clearly state the nature of the product or service, include a copy of the material to be broadcast, and be approved by the City Council. Rates for commercial time will be recommended by the Mayor and approved by the City Council.

    (e)

    At the direction of the Mayor or City Council the use of the City's television facility by other governments or government agencies for the purpose of broadcasting or cablecasting information or educational services of interest or benefit to the citizens of the City and surrounding communities may be allowed provided:

    (1)

    The jurisdiction presents its request in writing.

    (2)

    Material to be broadcast shall be presented in advance for review and approval by the POD.

    (3)

    The requesting jurisdiction agrees to compensate the City for use of the broadcast facility. The amount of such compensation shall be determined by the POD. All funds received in this manner shall accrue to the general fund.

    (4)

    The inclusion of the programming does not significantly interfere with the broadcasting or cablecasting of City generated programs.

    (5)

    In the event of a difference of opinion between the Mayor and City Council with respect to any decision on any item in subsection (e) of this section, City Council shall have the superior authority.
