§ 3-14. Unlawful exposure of private parts including female breasts.

  • (a)

    It shall be unlawful for any person maintaining, owning or operating an establishment located within the City which is licensed for the sale or consumption of alcoholic beverages on the premises, whether or not such beverages are offered for sale or consumption, suffer or permit any person, while on the premises of such establishment, to expose to public view any specified anatomical area.

    (b)

    It shall be unlawful and an offense for any person while on the premises of an establishment located within the City, which is licensed for the sale or consumption of alcoholic beverages on the premises, whether or not such beverages are offered for sale or consumption, to expose to public view any specified anatomical area at any time.

    (c)

    The term "specified anatomical area," as used in this section, means any of the following:

    (1)

    Less than completely or opaquely covered:

    a.

    Human genitals or pubic region;

    b.

    Cleavage of the nates of the human buttocks; or

    c.

    That portion of the human female breast directly or laterally below a point immediately above the top of the areola; this definition shall include the entire lower portion of the human female breast, but shall not include any portion of the cleavage of the human female breast exhibited by a dress, blouse, shirt, leotard, bathing suit, or other wearing apparel, provided the areola is not so exposed.

    (2)

    Human male genitals in a discernibly turgid state, even if completely and opaquely covered.

    (3)

    Any covering, tape, pastie, latex spray or paint or other device which simulates or otherwise gives the appearance of the display or exposure of any of the specified anatomical areas listed in subsections (c)(1) and (2) of this section.

    (d)

    It shall be unlawful and an offense for any person to procure, counsel, aid or assist any person in violating any of the provisions of this section.
