§ 7-37. Hours of dredging operations.
(a)
It shall be unlawful for any person to operate or cause to be operated any dredge or to perform any other work in connection with dredging operations in the City between the hours of 11:00 p.m. and 7:00 a.m. on weekdays and between the hours of 11:00 p.m. on Saturday and 7:00 a.m. on Monday.
(b)
The POD may issue a permit authorizing all or any of the dredging operations prohibited by subsection (a) of this section when it is necessary to prevent damage to property or in other cases when, after investigation, it is determined that because of the location of the dredging operations, the distance to occupied residences and the manner and method of operation proposed, the operation will not constitute a nuisance to residents in the vicinity.
