§ 13-286. Required.
(a)
Any person who stores any hazardous material shall obtain and keep current a permit issued pursuant to this chapter. One permit shall be required for each storage facility. Additional permits shall be obtained for any storage facility thereafter connected, installed, constructed or substantially repaired. Applications for permits shall be submitted at least 30 days prior to the construction of any storage facility. Permits shall be submitted for amendment at least 30 days prior to any additional construction to or substantial modification of an existing storage facility. The permit holder shall notify the Fire Marshal of the additional storage of any hazardous material of a greater hazard class than that for which the facility holds a permit.
(b)
A permit is required for closure of a storage facility. The permittee shall apply for approval to close such storage facility not less than 30 days prior to the termination of the storage of hazardous materials at the storage facility. This 30-day period may be waived by the Fire Marshal on a showing of special circumstances. Such closure shall be in accordance with a closure plan which describes procedures for terminating the storage of hazardous material in each storage facility in a manner that:
(1)
Minimizes the need for further maintenance;
(2)
Minimizes or eliminates any threat to public health or safety or to the environment from residual hazardous material in the storage facility; and
(3)
Demonstrates that hazardous materials that were stored in the storage facility will be removed, disposed of, neutralized or reused in an appropriate manner.
