SubDivision I. In General |
§ 8-162. Scope of division.
(a)
All dwellings, apartments and roominghouses shall provide for a healthful environment with living facilities arranged and equipped to ensure such a condition.
(b)
This division contains the fundamental requirements which shall be observed in determining the fitness of a dwelling or apartment for human habitation.
(c)
This division also contains the fundamental requirements for commercial structures and for all vacant structures, which are now, or may be in the future, substandard with respect to inadequate maintenance, or otherwise may be deemed to constitute a hazard to the occupants or to the surrounding area.
(d)
All dwelling units, regardless of when constructed, shall comply with the following minimum standards which are found to be required for the public health and safety:
(1)
Sections 8-163, 8-164, 8-166, 8-167, 8-169; and
(2)
Section 8-165(1) and (4).
(e)
All dwelling units lawfully constructed in accordance with the then applicable codes, may continue as lawful, notwithstanding the provisions of this subdivision, provided that they meet the requirements of subsection (d) of this section. This division shall not make lawful a dwelling unit which was constructed in violation of the minimum housing code at the time of construction, but, rather, shall allow lawfully constructed dwelling units to continue, to the extent herein provided.
(f)
All dwelling units except as set forth in the foregoing subsection shall meet all requirements of this subdivision.
